1. Description of Service and Role of Arecibo Yachts

1.1. Online Advertising Platform: Arecibo Yachts provides an online platform where users ("Users," "you") can pay a subscription fee to create and display listings for the sale of their yachts.

1.2. Arecibo Yachts is an Advertising Venue, Not a Broker: You acknowledge and agree that Arecibo Yachts is solely an advertising venue. We are not a yacht broker, dealer, or agent for any User. Arecibo Yachts is not a party to any agreement, negotiation, or transaction between a buyer and a seller. We do not represent any party, handle funds, or secure transactions.

1.3. No Guarantee or Warranty: Arecibo Yachts does not inspect any vessel listed on the Site. We do not guarantee, warrant, or make any representations regarding the accuracy, truthfulness, quality, condition, legal title, or safety of any vessel listed. The responsibility for all due diligence, including professional marine surveys and title searches, rests solely with the Users of the Service.

2. User Obligations and Responsibilities

2.1. Eligibility: You must be at least 18 years of age and have the legal capacity to enter into a contract to use our Service.

2.2. Legal Ownership: You must be the legal owner of the vessel you list for sale or be formally authorized by the legal owner to do so.

2.3. Listing Accuracy: You are solely responsible for the content of your listings. All information provided, including the vessel's specifications, condition, history, and asking price, must be truthful, accurate, and not misleading.

2.4. Content Responsibility: You are legally responsible for all text, photographs, and other materials ("Content") that you upload to the Site. You warrant that you own or have the necessary rights to use and publish your Content.

3. Fees and Payment

3.1. Listing Fees: Arecibo Yachts charges a fee to list a vessel on the Site. The current fees are detailed on our pricing page. All fees are quoted in Canadian Dollars (CAD).

3.2. Payment Processing: All payments are processed through a secure third-party payment processor (e.g., Stripe). Arecibo Yachts does not collect or store your full credit card information.

3.3. No Refunds: All listing fees are non-refundable.

4. Intellectual Property

4.1. User Content: By posting Content on the Site, you grant Arecibo Yachts a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your Content in connection with the Service and its promotion.

4.2. Our Property: The Arecibo Yachts logo, brand, and all content on the Site created by us are the exclusive property of Arecibo Yachts and are protected by copyright and trademark laws

5. Limitation of Liability and Disclaimer

5.1. Disclaimer: You use the Service at your own risk. The Service is provided on an "as is" and "as available" basis. Arecibo Yachts expressly disclaims all warranties of any kind.

5.2. Limitation of Liability: Arecibo Yachts shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service, or for the cost of procurement of substitute goods and services or resulting from any goods or services purchased or obtained or messages received or transactions entered into through the Service.

6. Indemnification

You agree to indemnify and hold Arecibo Yachts, its officers, directors, employees, and agents harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

7. Termination

Arecibo Yachts reserves the right, in its sole discretion, to terminate your access to the Service, remove any listing, or ban any User without notice for conduct that violates these Terms or is otherwise harmful to other Users or the Site.
